Trademark Opposition for Proprietorship is a statutory legal remedy that allows a sole proprietor to object to a conflicting trademark application published in the Trademark Journal. If a trademark filed by another party is identical, deceptively similar, misleading, or likely to cause confusion with an existing proprietorship brand, filing an opposition is the only way to stop its registration at the pre-registration stage. A proprietorship’s brand—name, logo, tagline, or symbol—is a business asset, even if owned by an individual. Trademark opposition safeguards that asset from misuse, dilution, and unfair competition. Trademark opposition must be filed within 4 months from the date of publication in the Trademark Journal. This deadline is strict and cannot be extended.
